नई दिल्ली: पर्यावरण संरक्षण को सर्वोच्च प्राथमिकता देते हुए सुप्रीम कोर्ट ने मंगलवार को स्पष्ट किया कि पेड़ों की अंधाधुंध कटाई मानव जीवन के विनाश से भी अधिक हानिकारक हो सकती है. न्यायालय ने पर्यावरण संरक्षण के प्रति कठोर रुख अपनाते हुए, अवैध रूप से पेड़ काटने वालों पर प्रति पेड़ 1 लाख रुपये का जुर्माना लगाने के आदेश को मंजूरी दी.

बिना अनुमति पेड़ काटना अब भारी पड़ेगा

जस्टिस अभय एस ओका और जस्टिस उज्जल भुइयां की पीठ ने कहा कि कोई भी व्यक्ति या संस्था, बिना अधिकृत अनुमति के, पेड़ नहीं काट सकती. यह निर्णय एक याचिका की सुनवाई के दौरान आया, जिसमें एक याचिकाकर्ता ने पेड़ काटने पर लगाए गए भारी जुर्माने को चुनौती दी थी. अदालत ने इस अपील को खारिज कर दिया और साफ किया कि पर्यावरण को नुकसान पहुंचाने वालों को किसी भी प्रकार की छूट नहीं दी जाएगी.

कानून का उल्लंघन नहीं किया जा सकता

शीर्ष अदालत ने वरिष्ठ अधिवक्ता एडीएन राव के इस सुझाव को स्वीकार किया कि अपराधियों को यह संदेश दिया जाना चाहिए कि पर्यावरणीय कानूनों को हल्के में नहीं लिया जा सकता. सुप्रीम कोर्ट के इस फैसले से यह साफ हो गया कि अवैध कटाई को रोकने के लिए सख्त दंड का प्रावधान आवश्यक है.

454 पेड़ों की अवैध कटाई पर 4.54 करोड़ का जुर्माना

कोर्ट ने केंद्रीय अधिकार प्राप्त समिति (CEC) की रिपोर्ट को मान्यता देते हुए शिव शंकर अग्रवाल द्वारा अवैध रूप से काटे गए 454 पेड़ों के लिए 1 लाख रुपये प्रति पेड़ के हिसाब से कुल 4.54 करोड़ रुपये का जुर्माना लगाया. उनके वकील, वरिष्ठ अधिवक्ता मुकुल रोहतगी ने अदालत से जुर्माने की राशि कम करने का अनुरोध किया और कहा कि उनके मुवक्किल ने अपनी गलती स्वीकार कर ली है. साथ ही, उन्होंने यह भी निवेदन किया कि अग्रवाल को पर्यावरण सुधार के लिए पौधारोपण करने की अनुमति दी जाए.

अदालत ने जुर्माने की राशि कम करने से इनकार कर दिया, लेकिन पौधारोपण की अनुमति प्रदान कर दी.

ताज ट्रेपेजियम जोन (TTZ) आगरा स्थित ताजमहल और अन्य ऐतिहासिक धरोहरों के आसपास 10,400 वर्ग किलोमीटर क्षेत्र को कवर करता है. इसका उद्देश्य इन ऐतिहासिक स्थलों को प्रदूषण और पर्यावरणीय गिरावट से बचाना है. सुप्रीम कोर्ट ने 1996 में इस क्षेत्र में बड़े पैमाने पर वृक्षारोपण करने का निर्देश दिया था, जिससे यह क्षेत्र हरा-भरा और प्रदूषण-मुक्त रहे.

अदालत के सख्त निर्णय का संदेश

सुप्रीम कोर्ट के इस निर्णय से स्पष्ट हो गया है कि पर्यावरण को क्षति पहुंचाने वालों को अब गंभीर परिणामों का सामना करना पड़ेगा. यह आदेश न केवल हरित संरक्षण को बढ़ावा देगा, बल्कि लोगों को प्राकृतिक संसाधनों के प्रति अधिक जागरूक और उत्तरदायी बनाने में भी सहायक होगा.
