नई दिल्ली: सुप्रीम कोर्ट ने सोमवार को चुनावों में 100% VVPAT (वोटर वेरीफाइड पेपर ऑडिट ट्रेल) पर्चियों की मैनुअल गिनती की मांग करने वाली याचिका को खारिज कर दिया. याचिकाकर्ता हंसराज जैन ने इस याचिका में आग्रह किया था कि इलेक्ट्रॉनिक वोटिंग मशीन (EVM) से जुड़े प्रत्येक VVPAT की मैन्युअल गिनती अनिवार्य रूप से होनी चाहिए. साथ ही, उन्होंने यह भी मांग की कि मतदाता को अपने वोट की पर्ची को जांचने का अधिकार दिया जाए. लेकिन सुप्रीम कोर्ट ने स्पष्ट किया कि यह मामला पहले ही निपटाया जा चुका है और इस पर दोबारा सुनवाई की आवश्यकता नहीं है.

पहले भी हो चुकी है सुनवाई

सुप्रीम कोर्ट ने 12 अगस्त 2024 को दिल्ली हाईकोर्ट के एक फैसले के खिलाफ इस याचिका पर सुनवाई की. हाईकोर्ट ने पहले ही सुप्रीम कोर्ट के पूर्व के फैसले का हवाला देते हुए याचिका खारिज कर दी थी. चुनाव आयोग ने भी यह तर्क दिया था कि सर्वोच्च न्यायालय पहले ही EVM को एक सुरक्षित और पारदर्शी प्रणाली के रूप में मान्यता दे चुका है. इस मामले की सुनवाई चीफ जस्टिस संजीव खन्ना, जस्टिस संजय कुमार और के वी विश्वनाथन की बेंच ने की.

याचिकाकर्ता की दलीलें और अदालत की प्रतिक्रिया

हंसराज जैन ने चुनाव आयोग को निर्देश देने की मांग की थी कि VVPAT सिस्टम को बेहतर तरीके से लागू किया जाए. उन्होंने सुझाव दिया कि प्रिंटर को मतदाता के लिए खुला रखा जाए ताकि वे अपने वोट की पुष्टि कर सकें और मतदान केंद्र छोड़ने से पहले प्रिंसाइडिंग ऑफिसर को पर्ची सौंप दें. हालांकि, कोर्ट ने इस प्रस्ताव को स्वीकार नहीं किया.

2024 में भी खारिज हुई थी याचिका

पिछले साल, सुप्रीम कोर्ट ने बैलट पेपर से चुनाव कराने और EVM तथा VVPAT पर्चियों की 100% क्रॉस-चेकिंग की मांग को अस्वीकार कर दिया था. हालांकि, कोर्ट ने कुछ शर्तों के तहत EVM की जांच का विकल्प दिया था.

EVM जांच के लिए तय की गई शर्तें

<ul>
	<li>यदि किसी उम्मीदवार को संदेह है, तो वह परिणाम घोषित होने के 7 दिनों के भीतर शिकायत दर्ज करा सकता है.</li>
	<li>इस शिकायत की जांच EVM निर्माता कंपनियों के इंजीनियर करेंगे.</li>
	<li>किसी भी लोकसभा क्षेत्र की कुल EVM में से 5% मशीनों की जांच की जा सकेगी. उम्मीदवार या उसका प्रतिनिधि इन मशीनों को चुन सकेगा.</li>
	<li>जांच का पूरा खर्च उम्मीदवार को स्वयं वहन करना होगा.</li>
	<li>यदि EVM में छेड़छाड़ साबित होती है, तो शिकायतकर्ता को खर्च की राशि वापस कर दी जाएगी.</li>
</ul>

पहले भी उठ चुका है यह मुद्दा

2019 में लोकसभा चुनावों से पहले 21 विपक्षी दलों ने सभी EVM के 50% VVPAT पर्चियों से मिलान करने की मांग की थी, लेकिन इसे स्वीकार नहीं किया गया. बाद में, चुनाव आयोग ने हर निर्वाचन क्षेत्र में केवल 5 EVM का मिलान करने का प्रावधान किया. 2019 में ही कुछ टेक्नोक्रेट्स ने भी इस संबंध में याचिका दायर की थी, जिसे सुप्रीम कोर्ट ने खारिज कर दिया था.

2023 में एसोसिएशन फॉर डेमोक्रेटिक रिफॉर्म्स (ADR) ने भी इसी विषय पर याचिका लगाई थी, लेकिन सुप्रीम कोर्ट ने इसे अस्वीकार करते हुए कहा था कि चुनाव प्रक्रिया पर अत्यधिक संदेह उचित नहीं है.
