देश भर की जिला अदालतों में बढ़ते मामलों के बोझ को कम करने के लिए केंद्रीय कानून मंत्रालय ने एक नई योजना बनाई है. इसके तहत, 785 सायंकालीन अदालतों की स्थापना की जाएगी, जो मौजूदा अदालत परिसरों में शाम के समय काम करेंगी. इन अदालतों का उद्देश्य छोटे आपराधिक मामलों, संपत्ति विवादों और चेक से जुड़ी समस्याओं की सुनवाई करना है.

सायंकालीन अदालतों का उद्देश्य और कार्य

इन सायंकालीन अदालतों में उन मामलों की सुनवाई की जाएगी जिनमें अधिकतम तीन साल की सजा का प्रावधान है. इसके अतिरिक्त, 6 साल तक की सजा वाले मामलों को बाद में इन अदालतों में शामिल किया जा सकता है. इस योजना के तहत, इन अदालतों का काम शाम 5 बजे से रात 9 बजे तक होगा. इससे मौजूदा अदालतों का कार्य दिन में जारी रहेगा, और शाम को इन अदालतों के लिए अदालत परिसरों का उपयोग किया जाएगा.

सेवानिवृत्त न्यायाधीशों की नियुक्ति

सायंकालीन अदालतों में काम करने के लिए पिछले तीन वर्षों में सेवानिवृत्त जिला न्यायाधीशों को अनुबंध के आधार पर नियुक्त किया जाएगा. इन्हें उनके अंतिम वेतन का 50% पारिश्रमिक और अन्य भत्ते दिए जाएंगे.

छोटे आपराधिक मामलों की सुनवाई

इन अदालतों में छोटे आपराधिक मामलों की सुनवाई की जाएगी, जिनमें तीन साल तक की सजा का प्रावधान हो. इसके अलावा, 6 साल तक की सजा वाले मामलें भी बाद में इन अदालतों में आएंगे. ओडिशा कानून विभाग के एक वरिष्ठ अधिकारी के अनुसार, इन अदालतों में सीआरपीसी-1973 की धारा 260, निगोशिएबल इन्स्ट्रूमेंट एक्ट और सार्वजनिक उपद्रव से संबंधित मामूली मामले भी सुनवाई के लिए आएंगे.

लंबित मामलों को लेकर सरकार की चिंता

देश में लंबित मामलों की स्थिति चिंताजनक बनी हुई है. राष्ट्रीय न्यायिक डेटा ग्रिड के आंकड़ों के अनुसार, 21 फरवरी 2023 तक भारत में 4.60 करोड़ मामले लंबित थे, जिनमें से 1.09 करोड़ सिविल मामले और 3.5 करोड़ आपराधिक मामले थे. इनमें से 44.55% मामले तीन साल से अधिक समय से लंबित हैं. यह स्थिति न्यायिक अधिकारियों की कमी के कारण और भी बढ़ रही है.

गुजरात का सफल मॉडल

यह योजना गुजरात के सफल मॉडल से प्रेरित है. वहां 2006 में सायंकालीन अदालतें शुरू की गई थीं, और 2014 में इसे और विस्तार दिया गया था. सरकार की योजना है कि इस नए प्रयास से लंबित मामलों की संख्या में कमी आएगी और जनता का न्यायपालिका में विश्वास बहाल होगा.
