नई दिल्ली : दिल्ली उच्च न्यायालय ने मंगलवार को क्रिकेटर युवराज सिंह द्वारा दायर याचिका पर नोटिस जारी किया, जिसमें एकमात्र मध्यस्थ (मीडिएटर) की नियुक्ति की मांग की गई थी.

युवराज सिंह ने व्यक्तित्व अधिकारों के उल्लंघन और एक फ्लैट की डिलीवरी में देरी को लेकर एक बिल्डर के खिलाफ दिल्ली उच्च न्यायालय का दरवाजा खटखटाया है.

न्यायमूर्ति सी हरि शंकर ने बिल्डर मेसर्स ब्रिलियंट एटोइल प्राइवेट लिमिटेड को नोटिस जारी किया है. मामले को 5 अगस्त के लिए लिस्ट किया गया है.

एक अपार्टमेंट की खरीद पर 1 करोड़ 15 लाख का फायदा लेना हुआ था तय

युवराज सिंह ने अधिवक्ता रिजवान के माध्यम से एक याचिका दायर की है, जिसमें याचिकाकर्ता और प्रतिवादी के बीच 24 नवंबर, 2020 के समझौता ज्ञापन (एमओयू) को लेकर विवादों को सुनने और निर्णय लेने के लिए केवल एक मध्यस्थ की नियुक्ति की मांग की गई है, जो प्रतिवादी द्वारा शुरू की गई एक रियल एस्टेट परियोजना के प्रचार, समर्थन और वितरित करने के लिए उनके बीच काम किया गया था, जिसका उद्देश्य विस्तारित आबादी देह (लाल डोरा), गांव चंदनहुल्ला, तहसील, हौज खास, नई दिल्ली में &#39;स्काई मेंशन&#39; नाम से आवासीय भवनों का विकास और निर्माण करना था और &#39;रिसलैंड&#39; नाम दिखाना शामिल था.

याचिकाकर्ता और प्रतिवादी के बीच उक्त &#39;स्काई मेंशन&#39; परियोजना के प्रचार, समर्थन और वितरित के लिए याचिकाकर्ता की सेवाओं को शामिल करने पर समझौता ज्ञापन साइन किया गया. समझौता ज्ञापन में एक अपार्टमेंट की खरीद के खिलाफ 1,15,00,000 रुपये का फायदे लेना तय हुआ था.

दिसंबर 2020 में, याचिकाकर्ता ने दिखाए गए सैंपल अपार्टमेंट के आधार पर अपार्टमेंट बुक किया और उसे अपार्टमेंट नंबर 0012, 23वीं मंजिल, टावर ए, स्काई मेंशन आवंटित किया गया. यह भी कहा गया है कि 14,10,07,671 रुपये के बिक्री मूल्य पर अपार्टमेंट की खरीद के लिए याचिकाकर्ताओं और बिल्डर के बीच 5 फरवरी, 2021 की तारीख वाले बिक्री के लिए एक समझौता किया गया था.

दुर्भावनापूर्ण समझौते को समाप्त करने का आरोप

याचिका में आरोप लगाया गया है कि प्रतिवादियों ने कब्जे के प्रस्ताव में देरी की और 10 नवंबर, 2023 की तारीख वाले ईमेल के जरिए याचिकाकर्ता को कब्ज़ा पत्र जारी किया. दिसंबर 2023 में, कब्जे के लिए पेश किए गए अपार्टमेंट के निरीक्षण पर याचिकाकर्ताओं ने पाया कि यह दिखाए गए सैंपल अपार्टमेंट और 5 फरवरी, 2021 के बिक्री के लिए समझौते की शर्तों का स्पष्ट उल्लंघन है.

यह कहा गया है कि याचिकाकर्ताओं ने प्रतिवादियों के साथ कब्जे में देरी, खराब गुणवत्ता और परिवेश और अपार्टमेंट की बढ़ी हुई कीमत के मुद्दों पर बातचीत और चर्चा की.

27 अप्रैल, 2024 को, याचिकाकर्ताओं ने 5 फरवरी, 2021 को हुए बिक्री के समझौते का उल्लंघन करते हुए अपार्टमेंट की कीमत, गुणवत्ता और परिवेश के बारे में देरी और गलत बयानी के संबंध में हर्जाने और रियायत के साथ-साथ अपार्टमेंट की बेहतर गुणवत्ता के लिए एक कानूनी नोटिस भी भेजा.

याचिकाकर्ताओं ने बिक्री के समझौते के खंड 38 के संदर्भ में मध्यस्थता का आह्वान करते हुए नोटिस दिया. यह भी कहा गया है कि बिल्डरों ने 27 अप्रैल, 2024 के कानूनी नोटिस या 26 मई, 2024 के मध्यस्थता का आह्वान करने वाले नोटिस का जवाब दिए बिना, याचिकाकर्ताओं को दुर्भावनापूर्ण तरीके से समझौते का एक समाप्ति पत्र जारी किया.

18 प्रतिशत के साथ भुगतान की राशि मांगी गई

याचिका में कहा गया है कि समझौते को गलत तरीके से समाप्त करने पर याचिकाकर्ताओं ने वापसी के लिए कानूनी नोटिस के माध्यम से 18 प्रतिशत ब्याज के साथ भुगतान की गई राशि की वापसी की मांग की.

प्रतिवादी नंबर 1 ने याचिकाकर्ताओं द्वारा लगाए गए सभी आरोपों का खंडन करते हुए 27 अप्रैल, 2024 के कानूनी नोटिस का जवाब भेजा. प्रतिवादी संख्या 1 ने 2 मई, 2024 को मध्यस्थता का आह्वान करते हुए नोटिस का उत्तर भेजा, जिसमें स्पष्ट रूप से मध्यस्थता कार्यवाही शुरू करने से इनकार कर दिया गया.

प्रतिवादी संख्या 1 ने याचिकाकर्ताओं के दावों को नकारते हुए दिनांक 03.06.2024 को रिफंड के लिए कानूनी नोटिस का उत्तर भेजा. प्रतिवादी संख्या 2 ने दिनांक 03.06.2024 को रिफंड के लिए कानूनी नोटिस और दिनांक 26.05.2024 को मध्यस्थता का आह्वान करते हुए नोटिस का एक सामान्य उत्तर भेजा, जिसमें मध्यस्थता कार्यवाही शुरू करने से इनकार कर दिया गया.

युवराज सिंह ने याचिकाकर्ताओं और प्रतिवादियों के बीच 5 फरवरी, 2021 को निष्पादित बिक्री समझौते से उत्पन्न विवादों को सुनने और निर्णय लेने के लिए एकमात्र मध्यस्थ की नियुक्ति के लिए प्रार्थना की है. यह भी आरोप लगाया गया है कि प्रतिवादी बिल्डर ने 24 नवंबर, 2020 को एमओयू की समाप्ति के बावजूद याचिकाकर्ता के ब्रांड मूल्य का व्यावसायिक उपयोग जारी रखा.
